The Bailyn Tactics: Prosecution by Any Means, including Impersonation, Withholding, and the
Perversion of Rule 11
As an Assistant U.S. Attorney, Jonathan Bailyn held the keys to the kingdom of discovery and the power of the
federal government. According to a litany of complaints filed in the Abdo matter, Bailyn didn’t just use that power,
he abused it to a degree rarely seen in the halls of justice.
The most explosive fact involves Bailyn impersonating an FBI Agent to threaten and intimidate with potential
witnesses. This “cowboy” tactic was coupled with a documented failure to follow the rules of discovery. While
Bailyn attested to the court that he had provided all evidence to the defense, he deliberately withheld years of
accounting records, the very documents Abdo needed to prove his innocence at trial.
Bailyn’s strategy extended to the defendant’s personal life and humanitarian efforts. He made false statements
regarding Abdo’s visa status to ensure he remained jailed, and flagrantly lying about Abdo’s legitimate
humanitarian projects, including AUE University and the Africa Food Basket Federation. To top it off, Bailyn
falsified the “Factual Basis” of the plea agreement, a direct violation of Federal Rule of Criminal Procedure
11(b), ensuring the court accepted a plea based on a narrative that was, in reality, a fabrication.

1. THREATENED and INTIMIDATED witnesses, to include IMPERSONATING of FBI Agent;
2. Made FALSE material statements in written motions, to include Criminal Complaint;

4. Deliberately withheld years of accounting from Dr. Abdo for trial purposes;
5. Provided FALSE material statements regarding visa status to secure Dr. Abdo in Jail and depriving him
from his rights;
6. LIED about Dr. Abdo’s humanitarian projects and activities (including AUE University and Africa Food
Basket Federation)
7. Falsified Factual basis in order to satisfy Federal Rule of Criminal Proceed 11(b
